Conciliation in the Shadow of the Law

Conciliation in the Shadow of the Law is back!

May 15, 16 & 22, 2024 Online 9.30am-1.30pm (AEST)

The course masterfully met the unique and complex needs of a conciliator in a regulated environment. So refreshing to hear from others in the field, so very diverse and interesting.
— Nathaniel Muller (Legal Services Commission)

The successful “Conciliation in the Shadow of the Law” — based on the workshop created by David Bryson and Michael Mitchell - has been REBOOTED and is now back for its eighth year! Professional Conciliators and trainers Alexandra Sidoti and Michael Mitchell, founders of Object Resolve, will present “Conciliation in the Shadow of the Law” in 2024.

We have adapted the 2 full-day workshop to a shortened 3-half day Zoom course, with small group discussions and tailored sessions on day three.

The workshop is a unique training opportunity designed for conciliators by experienced conciliator practitioners and has significant relevance to ADR practitioners working within the legal system or statute.

The workshop explores the dynamics of how conciliation operates in the ‘shadow of the law’ and aims to develop your dispute resolution skills. The workshop is about conciliation (not mediation). It illuminates a variety of particular and nuanced strategies required to operate within statutory or industry-based dispute resolution schemes.

Note numbers are limited to enhance learning opportunities!

In the Workshop, presented by Object Resolve, participants will:

  • Understand the differences between mediation and conciliation

  • Explore different models of conciliation

  • Bring neutrality while utilising your specialist knowledge into the room

  • Learn new approaches and styles to manage challenging situations

  • Workshop real-life disputes in small group discussions

I valued the opportunity to share knowledge and experience with other ‘mediators’ also working within the shadow of the law. The workshop reinforced the subtle and not-so-subtle differences between mediation and conciliation and the importance of accurately representing the nature of the dispute resolution process being offered to participants. I would strongly recommend the workshop to conciliators and mediators alike.
— Vanessa Mathews, MD, Mathews Family Law & Mediation Specialists
It was wonderful to attend a workshop that addressed the theory & practice of what conciliators do in a blended process.
— Pina Federico (Family Law Registrar)
The course was pitched at the perfect level, with enough context & theory to understand the ‘whys’ of conciliation but then supported with the practical actual ‘hows’ of conciliation. The fact that the content evolved depending on participants needs was excellent. All round this course is terrific and I will be recommending it to anyone who practices conciliation, be that an artist or a novice in the craft.
— Mersina Stratos (Conference Registrar - Administrative Appeals Tribunal)
The smaller groups were fantastic and made it easy to interact and share knowledge. Presenters were extremely knowledgeable and engaging. The course was a great skills refresher and a good opportunity to evaluate may own practice as a Conciliator.
— Catherine Maher (Conference Registrar, Children’s Court of Victoria)

It was wonderful to be able to attend a course aimed solely at Conciliators. Finally, I felt as though all of the topics, issues and discussion were relevant to me. Very practical and I really enjoyed learning from conciliators across different jurisdictions.
— Alyssa Duffy (Chief Executive Officer – Workplace Injury Commission)
Of all the ADR courses/workshops I have attended over many years, this is the most appropriate one for ADR practitioners who are conciliators. It was a joy to attend a workshop where all the participants practised the same ADR process - conciliation!
— Angelo Moretti (Manager Conciliation Services, Superannuation Complaints Tribunal)
I found the course extremely valuable. Despite the range of experience in the room across a spread of jurisdictions, the course was pitched in such a way we all came away with a better understanding of conciliation and an increased spread of tools to employ in practice. It worked well having a small group as this seemed to encourage active participation. I learnt a lot from other participants as well.
— Lara Proske, Senior Legal Officer, AAT
An excellent course to prepare a “traditionally” trained mediator to move into conciliation. It helped me consolidate my thoughts on the differences and allowed me to move into a more directive role. Thank you for this.
— Vince Thorne (Mediator, conciliator, rural financial counsellor)
